In accordance with the provisions of Law No. 239/2008 on transparency in the decision-making process, the Ministry of Energy announces the initiation of the drafting of the Government Decision regarding the repeal of certain Government Decisions.
The draft will be developed pursuant to Article 65, paragraph (1) of Law No. 100/2017 on normative acts. Repeal is a technical-legal procedure by which the provisions of a normative act that no longer correspond to the balance between social regulation needs and legal provisions are removed. Furthermore, paragraph (2) of Article 65 of the aforementioned Law states that repeal occurs in the following cases:
a) to cancel the provisions of a normative act that conflict with provisions of another normative act of equal or superior legal force;
b) to eliminate inconsistencies and ambiguities;
c) to relieve the legislation of outdated norms.
The draft stems from the need to streamline the legal framework by removing outdated normative acts and government policies, in accordance with Article 65, paragraph (1) of Law No. 100/2017 on normative acts.
